The city of Duncanville wants a judge to declare the Cherry Pit swingers club a public nuisance and close it down.

Jim Trulock, who runs the club in his home, sued the city Dec. 12 over a new ordinance that bans sex clubs. Duncanville filed its answer Monday and countersued Mr. Trulock.

On weekends, the 59-year-old and his partner, 29-year-old Julie M. Norris, turn their home near Cedar Ridge Drive and Interstate 20 into the Cherry Pit, where guests can mingle, dance and have sex.

The City Council unanimously adopted the ordinance in November. City officials say they were acting in response to complaints about the Cherry Pit.

The ordinance classifies sex clubs as a public nuisance. City officials also contend that the Cherry Pit is an unlicensed sexually oriented business operating in a residential area. Mr. Trulock denies that the club is a business; he has said he accepted donations but didn't have a cover charge.

Mr. Trulock's "use of the premises as a sex club is detrimental to the health, safety and welfare of the citizens of the city of Duncanville," the city's filing says. Mr. Trulock "does not have any policy or measures in place to safeguard against the spread of sexually transmitted diseases, and thus the activities at the premises pose a risk to the public health."

Mr. Trulock's attorney, Ed Klein, said the city is trying to regulate private acts in a private home. The ordinance violates his client's privacy and due process rights, he said.

Mr. Klein also contends that the ordinance is so broad and vague that it could criminalize the sexual behavior of almost everyone in Duncanville.

The owners of an "adult nightclub" at Woolloongabba have hit back at news reports referring to them as a "swingers' club".

Owners Bryan and Leesa Horn have submitted an application with the Brisbane City Council to operate their sex-on-premises club, Couples International.

"We're very happy with our relationship with the council; and it was council who decided to use the word 'nightclub' for the venue," Mr Horn said.

Mr Horn said the couple was working to dissolve the "mythical stereotype" that surrounded the idea of a sex-on-premises club.

The club is designed like a regular nightclub, with a dance floor and bar, but with separate rooms that couples can use to participate in sex, he said.

It is housed in a converted tile showroom, not a garage, as has been reported.

Strict rules apply to all visitors to the club, he said, with any rule-breakers removed immediately and not allowed to return.

"The focus of the club is somewhere adults can go to be adult," Mr Horn said.

"Of the people that come, 15-20 per cent do 'play' (have sex) there - most of our visitors come and have a look and have a chat and go home," he said.

Mr Horn described some of the club's visitors as "small-s swingers".

Couples can invite another visitor to join them, or swap partners, but only when one party issues an invitation and the ...

Many folk who enjoy the swinging life claim the indulgence stimulates their couple time and enhances their relationship. Some women find swinging liberating in a society that suppresses female sexuality. And there are those who simply enjoy the thrill of going nude for a night.

No longer the dubious wife-swapping of the 1950s, the modern, popular and very legal swingers venues, such as the notorious Mike's Place in the city, offer live entertainment, finger food, bar facilities, a masseuse and room full of folk looking to spice up their sex lives ... for a small fee, of course.

They even throw in condoms and lube; a consideration you'd be unlikely to enjoy should you shag a stranger picked up at a pub in the city or the Val of a weekend.
As such, fly you solo or partnered - if getting your groove on is the goal - seems that these swingers house parties offer real value for money. Entry isn't restricted to the married sort. Couples of all kinds and singles of the straight or bi-sexual persuasion are welcome. However, stricter admittance rules and higher entry fees apply to the solo male. A discriminatory measure perhaps? An interesting point nonetheless.

Yet swingers clubs remain a much hushed, recreational-sex subculture, largely ignored by Brisbane society because most of us have our reservations as to the morality of the practice and fear of the stigma attached.

The thought of your partner bonking someone else even with your permission spells the beginning of the end to many of us in relationships because it raises all those difficult questions about fidelity and the strength of your commitment.

Is there greater trust demonstrated by a partner willing to let their better half explore their sexuality openly, confident that their love shall conquer all? Or is it foolish to think that sex with strangers comes with no strings attached?

Regardless of where you stand on this spectrum, if you're thinking about having a swing at the swingers' life, think carefully about your motivation. Honest communication and self awareness is the key and, for crying out loud, don't do anything you don't really want to do.

HOLLY HILL -- One person's sexual bliss is another's angst when it comes to a six-bedroom house overlooking the Halifax River.
Neighbors complained to Holly Hill officials about parties in this leased house on Riverside Drive.
Matthew Early says he has been harassed and his personal rights infringed upon by neighbors who complained to City Hall that he illegally hosted swingers' parties in a leased house on Riverside Drive.

The issue could be settled Wednesday during a 2 p.m. hearing before Special Magistrate Charles Cino of Flagler County at City Hall.

After a Nov. 1 code citation for operating a business without a license, Early says he tried to cooperate by not collecting money from dozens of guests who came to his parties.

Some guests came via a Web site advertising Never Ending Bliss. Early says he removed any mention of money from the Web site, but on Dec. 15, a second cease-and-desist order stated that Early's intent was "to operate a private club."

Early says he now lives at the Riverside address with his partner, Nikki, and her children but only has a few friends over -- no large parties -- when the children are away. He is looking for a new location, he says.

"They say my whole intention was to run a business," Early says. "It's not. We don't charge at the door and they are house parties. The big thing is, they are calling us a club, but nobody pays dues. It's just semantics."

Early says he has done nothing wrong but "can name houses that have chess clubs and bridge clubs."

"There are houses in this neighborhood that run manufacturing businesses out of their homes, yet people are complaining about us," Early says. "People have the notion that everybody (at the parties) is naked and having orgies."

The Web site no longer advertises a club but has a message from Early saying ...

Weirton officials said a local bed and breakfast that caters to alternative lifestyles is violating a city code.
Rosemont Manor, also known as Our House on the Hill, caters to fetish parties, swingers, nudists, and S&M lifestyles.

Because of the activities, city officials said they notified owner Rose Susko in early December that she was violating city code.

In a written notice to Susko dated Dec. 11, Weirton's UDO administrator Jim McHenry said, "Your permit was approved for a Bed and Breakfast/ Wedding and Reception facility....any additional uses must be likewise approved by this office. Since, no application for expanded use has been made...this is a violation of the City of Weirton, Unified Development Ordinance."

In November, Susko defended her business and said it does not pose a threat to residents on Marland Heights.

A house in Holly Hill, Fla., that was transformed into an adult swingers' club remains at the center of a controversy even though neighbors got the city to temporarily close it.

The Neverending Bliss Swinger's Club was operated out of the Holly Hill home that accommodates 20 couples and features a dancing pole in the living room.

Club owner Matthew Early told Local 6 News that he is proud to be a swinger and he is fighting to do it.

"It is not about the sex," Early said. "It is about the people. I am doing nothing illegal. I have no complaints, no police calls. We are having parties."

"Those parties have been the topic of conversation on the Internet, in Holly Hill and now at City Hall," Local 6's Louis Bolden said.

"It has nothing to do with the type of business being operated," Holly Hill City Manager Joe Forte said. "It is just the fact that it is a club. It can be any type of club. They are not permitted in residential zoning."

The city has notified Early to stop having the parties until a special magistrate makes a ruling.

On Wednesday, a special magistrate reviewing the case did not make a ruling in the case, saying he needed more time to review the evidence.

Early said there is sexual activity at the parties but it is all legal, Bolden reported.

"I don't understand how it could be possibly be legal to have that sort of thing in a quiet, residential neighborhood," a homeowner said.

"I will fight for the lifestyle," Early said. "This has nothing to do with money. This has nothing to do with anything. It has to do with the lifestyle."

City officials said they will write an ordinance that prohibits swinger's clubs, Bolden said.

Outside by the pool were big red beds, draped with wispy curtains. And these beds were not for tanning. It was very quickly clear that at this clothing-optional resort, most enjoyed that option. Nudity was the norm. After all, this was Desire, the second-best-known "swingers" resort on the planet.

Swinging is when husbands and wives, or boyfriends and girlfriends, swap partners with other couples and sleep with people who are not their husbands and wives, or boyfriends or girlfriends. And Desire is just the latest example of entrepreneurs cashing in on what they see as a growing lifestyle and, as a result, a lucrative business opportunity.

Robert McGinley, the 72-year-old founder and CEO of Lifestyles Organization, the world's leading company devoted to "swinging," believes that one specific element makes swingers resorts successful.

"Freedom — freedom of expression, freedom to be what you want to be, freedom to be stark naked nude next to someone, and they don't care," he said.

"They want to be able to, if they're, say, here in the Jacuzzi or in the disco dance, and get turned on by another couple, those two couples want to be able to go someplace like this bed that I'm sitting on right here and take it a step further — sexual exploration."

You can call it wife-swapping, call it creepy — call it what you like, but it appears that the business of swing is booming.

According to the Allentown Morning Call, Allentown, PA, the local city council has decided that it is illegal for a group of couples to assemble  in a local club for a social get together because they are swingers.

According to the article published Saturday, Club Kama Sutra held its first $60-per-couple party at Silhouette Showbar, 111 E. Station Ave., last week and had scheduled another, titled ''Back to School,'' for last night but Coopersburg officials employed a distinctly unsexy tactic - zoning laws.

Complaints were received from the community.  Will this scene be next?



''If they open up Saturday night [for a private party] they'll be cited,'' Borough Manager Dan Stonehouse said Friday. ''They can apply for a permit, but it would be denied, because members-only clubs are not allowed in that zoning district.''

The party last week attracted only a handful of people, plus officers from the state police liquor control enforcement bureau who conducted an inspection after receiving complaints from the community. They ordered Silhouette's to be closed after discovering its health permit was invalid; a health inspection was scheduled for Friday evening, and the facility was expected to be open tonight.

The borough chose a typical road in dealing with the club, said Mary McNeill, a municipal law attorney from New York who compiled a swing club case law study for the advocacy group Morality in Media. Communities that want to shut down such businesses generally resort to old-fashioned regulatory tools, particularly health, nuisance and zoning laws.

''For the most part, the law essentially holds swing clubs can be regulated provided they fall under the category of being a business,'' she said.

''It's fine if you get together with your friends and do whatever you want — that's private people doing private things. However, if you open a club essentially to strangers and have a membership and charge people money to enter, that becomes a business. And businesses can be regulated by municipalities in terms of licensing.''

She cited Phoenix as the best example of a city crafting a legally watertight law against swing clubs. The law, adopted in 1998 with the aim of preventing the spread of sexually transmitted diseases, says any business falling under the category of a ''live sex act business'' is automatically considered a nuisance. The city does not have to prove the club is a nuisance; it simply has to prove the activity is taking place.

By defining the activities that would qualify as live sex acts — and by exempting plays, ballet and other non-obscene performances — Phoenix created a law that eliminated the clubs from city limits and passed muster in the courts, McNeill said.

Residents of Coopersburg were appalled that the strip club — itself a bone of contention in the little borough — had agreed to book sex parties.

Steve DiDonato, the restaurateur who owns the Abruzzi on Main and tipped officials to the swing club plan after representatives of Club Kama Sutra offered to buy his business, said he kept a curious eye on the club during its debut party last week.

''The most cars they had in the parking lot was eight, and that was at 11 o'clock,'' he said. ''It's almost comical, but the thing that gets me is that the place is so skeevy. It really is a disgusting place.''

On the hit ABC show "Desperate Housewives," cheating destroys marriages because spouses lie and get caught.

But we found couples who say they have found a way to enjoy the company of others without the deception. It's called the "lifestyle," or swinging, an arrangement in which couples have sex with other couples, and there is no secrecy.

Brian and Olga Depenbrock got married four years ago. Now they run a business together, and after work they like to go to a club in Fort Lauderdale, Fla., called Trapeze, which also has branches in Atlanta and Philadelphia.Trapeze looks like other nightclubs, with a dance floor, buffet, bar.

But it's not like other clubs, because in back there's a locker room where couples can get undressed and, if they want, have sex in different bedrooms with other couples — or watch one another in hot tubs. It's called swinging or the "lifestyle."

Isn't it immoral? Four couples I talked to said no, it's a good thing.

"What we do is not illegal. And I don't believe it's immoral," said Brian.

Chris, who takes part in the lifestyle with his wife, Lavonne, said, "I don't want to be 85 years old, looking back on my life, like, 'Man, I didn't have enough sex in my life.' " Like most of the couples we talked to, Chris and Lavonne didn't want their last names used.

Another swinging couple, Bob and Tess, were college sweethearts. They've been married 19 years, and five years into their marriage they decided to try the lifestyle.

"Tess was the first woman I ever kissed in my whole life. So you always have an innate curiosity about 'How would another woman feel?' I no longer have that curiosity," Bob said.

Swinging was Tess' idea. She heard about it from a girlfriend and was intrigued. She figured their relationship was strong enough to give swinging a try. "You have to be completely open and honest with each other," she said.

I have never been faithful to anyone, and I have had many relationships with men and women. Some found out, some didn't. I have finally found someone I feel like I can spend the rest of my life with. I am happy with him on every level, but I still cheat. I have been told this could be sociopathic, but I'm not sure. I have always really loved sex, all kinds, and have done everything short of urine, feces or anything illegal. I don't have any guilt, but I don't want my boyfriend to find out and leave me, or worse, stay with me as I continue to break his heart through constant cheating. Would therapy help? A: Why stop, SKANK?

You say it's not the skanking around that's making you unhappy — you enjoy the sex, you enjoy multiple partners, you enjoy everything short of urine/feces/criminal. If you're telling the truth — if you're not glossing over some deep-seated pain — the sex isn't the problem. What's troubling you is the deceit. You're worried that this boy, like the boys and girls before him, will be hurt when he finds out you're a lying, cheating skank.

But you can be a skank — and I'm using the term in the sex-positive sense — without lying or cheating. Have you tried being honest with potential boyfriends and girlfriends about your tastes and track record? Where there are no lies of commission or omission, SKANK, there's no deceit. And where there's no deceit, there are no boys whose hearts are broken when they find out they are being cheated on. Let prospective partners know who you are and what you're about before things get serious, SKANK, and your problem will be solved — i.e., boys and girls who want monogamy won't get involved with you. You'll encounter some rejection, sure, but if you keep the honesty thing up, sooner or later you'll find a partner who doesn't mind or thoroughly enjoys being cheated on. Ta-da, everybody wins.

Now, my advice would conclude with the previous paragraph if it weren't for the last line of your letter: "I just wish I could stop." If that's how you truly feel, SKANK, then perhaps there is something pathological about your behavior. And here's a little more evidence that your sexual adventures may not be coming from a particularly healthy place: Someone like you, SKANK, surely knows that there are men and women out there — wannabe swingers, the polyamorous, the growing legions of cuckold fetishists — that would kill to be with a woman like you. The fact that you haven't sought out any of these people and have instead dated and deceived the monogamously inclined is revealing. And what it reveals isn't pretty: If you've avoided the swingers, the polyamorous and the cuckold fetishists, SKANK, and sought out only guys and girls that will be hurt by your actions, then you're not skanking around because you enjoy it. You're doing it to wound and drive off people who attempt to get close to you. And that's something you should definitely hash out with a shrink.
